Terms of Service & User Agreement

Version 2.0 | Effective: 2026-08-02 Serendib Fortunes Pvt Ltd. ("VitaeGene", "we", "us")

1. Agreement

These Terms of Service, together with the documents referenced herein (Privacy Policy, Subscription Terms, AI Credit Terms, AI Usage Policy, Health Monitor Agreement and our Disclaimers), form a binding agreement between you and VitaeGene. By creating an account or using any feature you accept these Terms.

2. Your Account

You must provide accurate registration information, keep your credentials secure, and are responsible for all activity under your account. You may not share or transfer your account. You must be at least 18 years old (or the minimum age of majority in your country) to register; users aged 13–17 may use VitaeGene only under parental or guardian supervision. VitaeGene reserves the right to suspend or terminate accounts that violate these Terms.

3. Licence (EULA)

Subject to your compliance with these Terms, VitaeGene grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the VitaeGene application for your own wellness and educational purposes. You may not copy, modify, reverse-engineer, redistribute, or create derivative works of the software or its content except as permitted by law.

4. Nature of the Service

VitaeGene is a wellness, nutrition and lifestyle intelligence platform. It is not a medical device, clinical record system, or diagnostic tool. No feature is intended to diagnose, treat, cure, or prevent any disease. Some features described in our communications or roadmap are planned or under review and may not yet be available; they become governed by these Terms once released.

5. Subscriptions & Credits

Paid plans (Essential, Pro, Premium) and AI Credits are governed by the Subscription Terms and AI Credit Terms respectively. Subscription benefits and features may change with future updates; we will give reasonable notice of material changes.

6. AI-Assisted Features

AI features are governed by the AI Usage Policy and our Disclaimers. AI output is educational only and may be inaccurate. You remain responsible for any decision you make based on it.

7. Acceptable Use

You agree to the Acceptable Use Policy. Misuse may result in immediate suspension.

8. Third-Party Services

VitaeGene may integrate with third-party services (e.g. Apple Health, payment processors, AI providers). Your use of those services is subject to their own terms.

9. Disclaimers & Limitation of Liability

VitaeGene is provided "as is" without warranties of any kind. To the maximum extent permitted by law, VitaeGene shall not be liable for indirect, incidental, or consequential damages arising from your use of the platform.

10. Changes to Terms

We may update these Terms. Material changes will require you to review and accept the updated version before continuing to use affected services.

11. Governing Law

These Terms are governed by the laws of Sri Lanka. Disputes shall first be mediated in good faith before any formal proceedings.
